This form is used to mutually rescind the original sales contract or to acknowledge that the financing condition has not been met because the lending institution did not accept the sales contract. This form is important in protecting a dealership from a claim that the dealership violated the bushing law, and should be used to: (i) document that the customer was given the right to obtain a refund of all consideration paid by the customer, and (ii) to establish that the customer voluntarily elected to enter into a new and different sales contract.
